1. Purpose

These Terms and Conditions of Sale (the "Terms") govern the contractual relations between the sellers registered on the Zelivry Market marketplace and their buyers. Any purchase made on the platform implies full and unreserved acceptance of these Terms.

2. Sellers and shops

Each shop present on Zelivry Market is operated independently by a professional or private seller who has accepted the platform's terms of use. Zelivry acts as a technical intermediary and not as a direct seller.

3. Orders

The order is validated upon receipt of the confirmation by e-mail or SMS. The seller has a reasonable period of time to confirm the availability of the items. In the event of unavailability, the customer will be informed and fully reimbursed if a payment has been made.

4. Prices and payment

• Prices are displayed in FCFA, all taxes included.
• Delivery charges are stated separately before the order is validated.
• Payment may be made online (Moneroo) or on delivery, according to the options offered by the seller.

5. Delivery

Delivery is carried out by the seller or by a partner carrier. Indicative timeframes are specified on the product page. Zelivry may not be held liable for delays due to events beyond its control (force majeure, strike, bad weather).

6. Order tracking

A tracking link is sent by SMS or WhatsApp once the order has been validated. You may also track your order in real time via our tracking page.

7. Returns and refunds

In the event of a problem with your order (missing, damaged or non-conforming item), contact the seller directly via the shop page within 48 hours of receipt. The seller undertakes to offer an exchange, a credit note or a refund according to the circumstances.

8. Liability

Zelivry may not be held liable for the content published by sellers, for commercial disputes between sellers and buyers, nor for indirect damages resulting from the use of the marketplace.

9. Personal data

The processing of your personal data is governed by our Privacy Policy. By placing an order, you consent to their processing for the purposes of performing and tracking your order.

10. Zelivry software subscription (plans, trial, grace period)

Beyond the marketplace, Zelivry is a software offered on a subscription basis (SaaS) by IBIG Soft. The following terms apply to use of the software by the professionals who open a space on it:

• Plans and no perpetual licence: access to the software is granted as a fixed-term subscription (monthly or yearly). No perpetual or lifetime licence is sold; the right of use ends at expiry in the absence of renewal.
• Six states of the space: the state of each space is computed automatically — Public demo, Discovery, Trial, Active plan, Grace period, and Read-only.
• Discovery: a free space with no end date, capped at 5 deliveries per month; beyond that, the extra deliveries become read-only. Some features (export, multi-user, API, reminders, assistant, customisation) are reserved for paid plans, and Discovery is limited to a single user.
• Trial: 7 days of access to the complete product (Premium plan), with no bank card and no automatic renewal. At its end, the space switches automatically to Discovery, with no cut-off or deletion. See the Trial Conditions.
• Grace period: 7 days after expiry during which access remains complete, to allow renewal.
• Read-only: once grace has passed without renewal, the space becomes read-only (viewing and export remain possible; creation and editing are turned off). Data is retained, and any purge occurs no earlier than day 90 after expiry, after prior warnings.
• Watermark: documents generated under the Discovery tier carry an origin notice (« Généré avec Zelivry — ibigsoft.com »), removed as soon as a paid plan is taken.
• Fair use: circumventing the Discovery cap by creating multiple accounts or by any other means is prohibited. Such circumvention may lead to the limitation or closure of the spaces concerned.

11. Governing law and disputes

These Terms are subject to the law in force in Côte d'Ivoire. Any dispute shall, failing amicable resolution, be submitted to the competent courts of Abidjan, where the publisher IBIG Soft has its registered office.
